泸州市民跨省买房 两年多地基还没打 玫瑰小镇项目工地上杂草荒芜(来源:华西都市报) 玫瑰小镇项目外面的销售中心早已大门紧闭(来源:华西都市报)   泸州市民赤水买房 两年多了还没打地基   开发商:法人代表在外寻找资金,最迟 3 月中旬能重新复工当地主管部门:项目出问题主要有三方面原因,正想办法解决   全款买房已两年多,但项目上部分楼栋还未打地基,交房变得遥遥无期。近日,泸州市民李群征拨打华西315维权热线,向记者讲述了他们跨省在贵州赤水买房的心酸经历。跨省买房,让泸州500多位购房者遭遇了维权难。针对这种跨省置业的情况,泸州市律师协会消费者权益保护专委会副主任冯骏律师表示,购房者可以从实地查看、审查资质、审核合同条款三个方面去尽量保护自己的合法权益。   市民爆料:   跨省买房 说好的时间却不交房   2013年,火热宣传的贵州省赤水市“玫瑰小镇”项目,在泸州开设了4个售楼部,泸州有500多人成为该项目的“准业主”。如今,他们利用QQ群,已组织成立了“玫瑰小镇业主维权委员会”。被推选为维权委员会主任的李群征告诉记者,“因为玫瑰小镇开发商多次违约,不按期交房赔偿违约金,投诉无果,为维护全体业主的合法权益,才建立了玫瑰小镇维权委员会。”李群征说,他们的维权行动都遵循合理、合规、合法的原则进行。   市民蒋波2013年9月份全款买的房子。“当时我买了后,还介绍我的亲戚朋友去买,一共买了十多套,如今项目交房却遥遥无期。”与她相似的,还有张林家,全家亲戚朋友一共在玫瑰小镇买了8套房子。“谁曾想原来说的2014年就要交房,后来又推到2015年的5月1日,如今一推再推,就在上个月,泸州的几个售楼部都已全部大门紧锁,项目法人代表也失联了。”张林的母亲说道。   开发商回应:   最迟3月中旬就能又重新复工   玫瑰小镇一曾姓财务总监接受了华西城市读本记者的采访。对于业主反映玫瑰小镇的开发商遵义市八方木置业有限责任公司的法人代表赵理失联,曾总说,赵理今年正月初五就出去找资金去了。之所以电话关机,是因为在项目出问题后,销售人员将法人代表的电话全部告诉了要求维权的业主。“这样一来,他每天都要接到无数业主的电话,根本就没法安心全力去找资金。”   而关于向业主承诺的违约金,曾总说,如果要赔的话,每个月的违约金都需要支付两百多万元。“而我们要是把这两百多万元都投入到项目建设上,起码又能起来一栋楼了。”曾总还向记者请求,让转达他们对业主们的解释。“我们现在已经联系好了施工队伍,最迟3月中旬就能又重新复工,也希望业主们能多给我们些时间。”曾总说,他作为财务总监,去年都在外面陪赵理找资金,而今年留在项目上,是因为项目需要一个主心骨式的人物。他说他能坦然接受记者的采访,也说明他们并非是要跑路而丢下业主不管。   主管部门表态:   正积极成立领导小组解决问题   赤水市住建局张局长23日下午1点半接受了华西城市读本记者的采访。张局长说赵理不是失联,他曾是赤水住建局房产科科长,2014年辞职,才三十八九岁。“根据局里面掌握的情况,赵理最近两年主要精力都花在融资上面去了。”“这个项目出问题,主要有三方面原因,一是项目自身策划问题;二是开发公司实力不足;三是受国家大的形势影响。”张局长说,玫瑰小镇项目是两河口乡的招商引资项目,本身开发公司法人因为项目非法占用林地,早就在公安局挂了号的。但一直考虑到乡镇招商引资不容易,政府一边帮助企业完善手续,企业也一边在进行项目推进与宣传,由于宣传比较好,前期推进比较快,在手续都还没办齐的情况下,就已销售七八百套了。“作为政府管理部门,我们依照依法处理的原则,肯定要保障购房者利益。这个项目主流整体还是不错的,从我们内心来说也是想促成这个项目建成,尽力帮助企业走出困境。”张局长说,作为曾经的同事,2015年国庆前夕他就曾让赵理回局里寻求帮助,“但他一直没来找过我们,在项目出问题的后期还有欺骗行为,对于他自身跟我们承诺的限期融资问题,都毁约过两三次。”   “如今我们市委市政府高度重视这个情况,昨天下午市里还给我发通知让今天下午过去开会,专门研究玫瑰小镇项目的善后问题。”张局长说,市里正考虑成立领导小组,由市领导牵头,进行维稳及资产清理工作,以便确定是否要重新招商引资的问题。   法律专家:跨省置业 应了解当地地方法规   泸州市律师协会消费者权益保护专委会副主任冯骏律师表示,针对这种跨省置业的情况,购房者可以从以下三个方面去尽量保护自己的合法权益。   第一,必须对房屋的环境进行实地查看,不能仅听开发商的口头介绍和一纸宣传;第二,应当对所售房屋的开发手续原件进行审查(五证:《建设用地规划许可证》、《建设工程规划许可证》、《建筑工程施工许可证》、《国有土地使用证》、《商品房销售(预售)许可证》),尤其是开发商是否取得预售许可证、是否进行了在建工程抵押等进行详细的了解,以确保购房者最终能够顺利取得房屋产权证;第三,在与开发商(或者是房屋销售中介商)签订购房合同时,一定要仔细审核合同的条款,而且最好使用当地住房和城乡建设厅推荐的合同版本,以减少开发商方面单方制定的合同文本所带来的风险。   冯骏说,对于影响到自己切身利益的事项,如价格、面积、交房时间、办证流程等事项,一定要与开发商方面形成书面的合同内容,不能盲目听信开发商方面的口头承诺;此外,可以与开发商方面约定“如果在双方合同的履行中发生争议,一律由购房人户籍所在城市的仲裁委员会仲裁解决”的条款,以减少购房人异地维权的成本支出和来回奔波之苦;同时,在接房时一定进行仔细的比对、验收,以保证收到的房屋与双方合同的约定、竣工验收报告的内容是否相符,从而减少以后房屋在使用过程中出现问题而造成困扰。   冯骏律师建议,跨省置业时,购房者除了应当知晓国家级的法律法规外,还应当对当地省级人大、政府的地方性法规和规章有一定的了解,以确定自己的相关民事行为与当地的地方性法律、法规没有矛盾和冲突,以减少不必要的纠纷。   冯骏律师认为,如果购房者认为自身的合法利益受到了侵害,可以到相关政府部门查询开发商的相关资质是否完备、特别是查询该项目是否能够最终达到购房者办理产权和取得房屋的合同目的。   如果政府部门的答复是否定的,那么就要考虑从合同无效或者可撤销的角度,向开发商进行主张,并要求开发商承担违约乃至于毁约的全部法律和经济责任;同时,冯骏律师还表示,如果开发商有资质,可以实现合同的目的而消极的不履行开发商自己的合同义务,那么广大购房者也可以通过法律程序要求开发商履行自己的相关责任,包括施工的完善、配套设施的安装、房屋的实际交接以及产权办理的相关程序的履行等。   最后,冯骏律师还表示,如广大购房者在签署合同时,对一些合同细节没有进行详细的约定,也可以依据《合同法》第60条至63条的规定,按照有利于实现合同的目的方式,依法督促开发商遵循诚实守信的原则,妥善地完成开发商自己的合同义务。   华西城市读本记者 李华刚 摄影报道 进入【新浪财经股吧】讨论相关的主题文章:
